Registration Act, 1908

Governs the public record of documents. Under Section 17, registration is mandatory for sale deeds, gifts, and long-term leases, failing which documents are inadmissible u/s 49.

Transfer of Property Act

Defines the fundamental legal requirements for Sale (Sec 54), Gift (Sec 122), and Lease (Sec 105). Sets the basic framework for creating and transferring valid legal titles.

Indian Stamp Act, 1899

Questions

Is registration of a Sale Deed mandatory?
Yes, under Section 17 of the Registration Act, 1908, any transfer of immovable property worth more than ?100 must be registered. An unregistered sale deed has no legal value and cannot be used as evidence in court.
What is the difference between Agreement to Sale and Sale Deed?
An Agreement to Sale (ATS) is a promise to transfer property in the future upon certain conditions (like payment). A Sale Deed is the actual transfer of ownership. ATS does not confer title; only a Sale Deed does.
Can a Gift Deed be cancelled?
Generally, a Gift Deed is irrevocable once accepted. However, it can be cancelled if it was obtained by fraud, coercion, or if a specific condition mentioned in the deed (like maintenance of parents) is violated under the Senior Citizens Act.
Is a Will valid without registration?
Registration of a Will is optional but highly recommended. A registered Will has higher evidentiary value and is harder to challenge on grounds of genuineness compared to an unregistered one.
What happens if I pay less Stamp Duty?
The document can be impounded by the Collector under Section 33 of the Stamp Act. You will have to pay the deficit duty plus a penalty (up to 10 times the deficit) to get it released and validated.
Do I need a lawyer for a Rent Agreement?
While standard formats exist, a lawyer ensures critical clauses (lock-in period, notice period, eviction grounds) are properly drafted to protect your interests and avoid future litigation.
